These terms and conditions govern the New Radicals 2018 awards (the “Awards”) which is an Award being run and managed jointly by the Observer and Nesta (“we”, “us” or “our”). (Please see section 17 below for our full details)

Please read the below terms and conditions carefully before submitting a nomination. By submitting a nomination, you (whether a nominator or nominee) accept these terms and conditions and agree to comply with them.

1. Nominations: A nominee can nominate themselves or be nominated by others. In order to make a nomination or be nominated you must be aged 15 or over (where an individual) and be a UK resident or, if an organisation (whether a group of people, company, charity or other legal entity), have a principal business or operating address in the UK.  For avoidance of doubt, Nesta and/or Observer and/or Judges may make nominations however Nesta and/or Observer staff may not be nominated. Judges who have made nominations will not be involved in the assessment of that nominee. Each nominator and nominee under the age of 18 at the time of nomination must provide written consent from his or her parent or guardian to the nomination and to these terms and conditions.

2. When submitting a nomination, you will be required to provide contact information for your nominee(s). If the entry is shortlisted we will contact the nominee(s) to obtain their consent to participate in the Awards and be selected as a New Radical, and to confirm their agreement to these terms. We may notify them that you are the nominator.  

3. Nominations are welcomed from unsuccessful nominees for any New Radical Award in previous years, and from winners of a previous New Radical Award, provided the projects or initiatives are different to the previous one nominated, and the new project or initiative  meet this Award criteria.

4i. Eligibility Criteria: Nominees can be individuals or organisations but they must comply with the eligibility requirements set out at paragraphs a to c below. A nominator may only nominate each nominee once but can submit multiple nominations for different individuals or organisations. a. A nominee can be nominated for either:

  • the work it does as an individual/organisation generally, provided it started operating after 1 January 2015 and has been operating for at least 6 months at the time of the nomination; or
  • a specific project it is running, provided the project itself started after 1 January 2015 and has been running for at least 6 months at the time of the nomination.  

b. The relevant work/ project carried out by the nominee must be based in the UK and not be primarily motivated by profit.

c. The nominee must be able to provide evidence on request showing that its work/project is meeting its goals and is sustainable.  

4ii. Submission of Nominations: Nominations must be submitted by completion of an online application form which shall be made available through a link on the Nesta and the Observer websites. You must provide the following information via the application form:

a. A contact name, email address and telephone number for both the nominee and nominator (if both are applicable); and

b. The name of the organisation/ individual nominated, and the name of its relevant service or project (if different) and:

i. a description of what it aims to do and why; and

ii. a brief history (for example how did it come about, when, funding, in what kind of setting).

5. All information disclosed in your nomination must be true, accurate and not misleading and you shall notify us immediately of any errors in or changes to the information provided. We may request additional information if necessary in order to assist the judges in coming to their decision. All material submitted as part of your nomination is generally non-returnable.

6. All material submitted as part of a nomination must be original, must not be copied, must not contain any third-party materials and/or content that you do not have permission to use, must not promote any goods or services or include any trade marks (other than those belonging to the nominee or those included incidentally), and must not otherwise be obscene, defamatory, distasteful, offensive, or in breach of any applicable law or regulation, or in breach of any confidentiality obligations owed to third parties. If we have reason to believe a nomination is in breach of this paragraph then we may not consider it and may disqualify it. By submitting a nomination, you grant Nesta and the Observer a non-exclusive, perpetual, royalty-free, worldwide licence to republish the entry without restriction in any and all media, including in electronic format and hard copy, and including on guardian.com and on www.nesta.org.uk, and you hereby irrevocably waive, for the benefit of the Observer and Nesta, all moral rights in the entry material to which you are entitled.

7. Closing Date: Entries open on 18 March 2018 and must be submitted by 11.59pm on 29 April 2018. Nominations received outside this time period will not be considered.

8. Judging: The judging panel will consist of representatives of the Observer and Nesta as well as invited external judges (please see details below in section 20). The judges will assess any nominations received by the closing date and which satisfy the eligibility criteria and comply with these terms and conditions. The judges’ decision on the 50 individuals and organisations to be named as New Radicals 2018 (the “New Radicals”) shall be final and no correspondence or discussion will be entered into concerning the results.  When selecting the New Radicals, the Judges will consider the extent to which, and how well, the entry combines new or familiar elements in an innovative way to meet a social or environmental challenge, utilises new ideas, and is changing Britain for the better, in the fields including but not restricted to Community action, Health, Politics, Science and Technology, Education, Environment, Employment/Jobs, Media, Architecture and the Arts, Business, and Food. Full details and the names of judges are available on request to the contact details below.

9. Any organisation or individual that (i) has ceased trading or is subject to liquidation, administration or similar proceedings; (ii) has been subject to a change in management, ownership or control since  its nomination; (iii) cannot be located or contacted by us; (iv) does not confirm that it wishes to be considered or selected within 14 days of being contacted to confirm its nomination or selection; (v) rejects its nomination or selection; (vi) does not comply with or breaches these terms and conditions; (vii) brings or is likely to bring  Nesta or the Observer into disrepute; (viii) does not provide us with requested proof of eligibility or parental consent; or (ix) is not eligible to be nominated or selected; shall be disqualified and shall not be eligible to be named as a New Radical. In the event of disqualification, we may select a new New Radical in accordance with the selection process outlined above.

10. Use of you Personal Information:

We are committed to protecting your privacy and we take all reasonable precautions to safeguard personal information you give to us. We will use that information in accordance with all relevant Data Protection Legislation and Regulations.

If you submit an application we will ask you for personal information such as your name, email address, and other contact details such as a contact phone number.

Please make sure that any personal details you provide are accurate and up to date, and let us know about any changes. If you are nominating another individual, please ensure that you have their consent to do so.

Your personal information will be used by both Nesta and the Observer as is necessary to process your nomination and to fully assess your application. Both Nesta and the Observer will be joint data controllers for the purpose of processing your information. We use Surveygizmo to process nominations, and they only process your information on our instructions. Surveygizmo operate in the US and comply with the EU-U.S. Privacy Shield Framework. Please see their privacy policy https://www.surveygizmo.com/privacy.

We will share your information with the judging panel that help us assess the nominations. The details of the judges are detailed in section 20 below. We may also share your information with other organisations and copywriters and that we may engage to help us run the Award.

If you give us consent to do so, we will also let you know about other Nesta and the Observer events and activities.

We will only keep any personal information for the purpose of operating the Award and we will securely delete information when it is no longer needed for that purpose. When this Award process has ended we will retain your information for 3 years for evaluation and business development purposes, and to provide you with future opportunities to apply for similar Awards in the future. If you do not wish us to contact you about future opportunities, please let us know by writing to use or emailing us at [email protected].

We may keep your information for our own legitimate business interests for statistical analysis purposes, so we can review, develop and improve our business activities, but we will only keep any personal information if it is necessary to do so, and will always put in place appropriate safeguards, including where possible anonymising or minimising the data retained.

By participating in the Awards, you consent to the collection, retention, usage and distribution of your personal information for the purposes outlined in this paragraph 10 and paragraphs 11 and 12.

11. Selected Finalists: In September 2018, the Observer will publish the list of New Radicals on its website and in its print edition and shall include interviews with a number of the New Radicals. The New Radicals selected for interview will be further profiled on Nesta’s website.  Nesta will host an event for the New Radicals in London in September 2018 to which a representative of each New Radical will be invited. Nesta will provide the New Radicals with access to networking opportunities from time to time.The Observer’s and Nesta’s decision about which New Radicals’ interviews to publish will be final. There are no prizes, reimbursements, or cash alternative and selected nominations cannot be sold or transferred in any circumstances.

12. Publicity: If your nomination is successful you agree to participate in publicity for the Awards. This may include carrying out an interview with the Observer if requested and supplying high resolution photographs at your own expense to be included in the publication of the list of New Radicals. You consent to Nesta and the Observer using your name, a summary of your nomination, and photographs and videos featuring you in promotion and publications relating to the Awards in any media and online. We will not disclose any commercially sensitive information marked as such which you have disclosed as part of your nomination, but ask that you do not disclose such information unless necessary.

13. General: Nesta and the Observer reserve the right to (i) vary these terms and conditions at any time; (ii) extend any deadlines or suspend or withdraw the Awards at our discretion; or (iii) request evidence of satisfaction of the eligibility criteria or parental consent where appropriate. Variations will take effect from the date they are posted on Nesta’s and the Observer’s website so you must check these pages regularly. The decision of Nesta and the Observer in all matters relating to the Awards is final and no correspondence will be entered into.

14. You must bear any costs relating to the submission of your nomination and the selected New Radicals are responsible for all costs and arrangements associated with nomination and selection, including those relating to travel to and attendance at the Nesta hosted event for the New Radicals.

15. Nesta and the Observer accept no responsibility whatsoever for any technical failure or malfunction, problems with postal collection or delivery, internet issues, damage to a computer from submitting a nomination or accessing Nesta or the Observer’s websites or downloading material, or any other problem which may result in any nomination not being properly received or registered, nor for any damage, loss, liabilities, injury or disappointment incurred or suffered by a nominee as a result of being nominated for the Awards or accepting selection. Proof of delivery of a nomination is not proof of receipt by us. All lost, damaged or incomplete nominations will be deemed invalid.

16. Nesta’s and the Observer’s aggregate maximum liability to you or anyone else under these terms and conditions (if any) will be limited to £100. Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury caused by negligence or fraudulent misrepresentation made by us.

17. Nesta and the Observer shall not be liable for any failure to comply with their obligations relating to the Awards where the failure is caused by something outside their reasonable control.  Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, cyber terrorism, hacking or any other circumstances amounting to force majeure.

18. These terms and conditions shall be governed by and interpreted in accordance with the laws of England and Wales and both parties hereby submit to the exclusive jurisdiction of the English Courts.

19. The Organisers are: Guardian News & Media Limited, Kings Place, 90 York Way, London, N1 9GU (“the Observer”) and Nesta , a company limited by guarantee and registered in England and Wales with company number 7706036 and a charity with registered number 1144091, whose registered office is 58 Victoria Embankment, London EC4Y ODE. (“Nesta”).

20. Judges: The following are the members of the judging panel.

  1. Michael Sheen, actor and activist with roles such as patron of Social Enterprise UK and UNICEF ambassador

  2. Stian Westlake, adviser to the minister for universities, science, research and innovation. He is co-author of Capitalism Without Capital (Princeton, 2017).

  3. Josh Babarinde, founder and chief executive of Cracked It, an award-winning social enterprise smartphone repair service staffed by young ex-offenders and youth at risk.

  4. Raheel Mohammed, a New Radical in 2012, he founded Maslaha, focused on making long-term change on issues such as health, education, criminal justice and women’s rights in Muslim communities.

  5. Mick Ward, chief officer for adults and health at Leeds city council.

  6. Cassie Robinson, strategic design director at Doteveryone and co-founder of the Point People, Tech for Good Global and the Civic Shop.

  7. Kerry Hudson, author of two award-winning novels: Tony Hogan Bought Me an Ice-cream Float Before He Stole My Ma and Thirst.

  8. Jaya Chakrabarti, Bristol-based digital activist and co-founder of open data anti-slavery register tiscreport.org and digital comms agency Nameless.

  9. Sylvia Douglas, founding director of MsMissMrs, a Glasgow based organisation that delivers empowerment programmes for women

  10. Ruth Ibegbuna, founder and CEO of RECLAIM,  a youth leadership and social change organisation.

  11. Mehmoona Pervaz, teenage campaigner from Bradford who helped set up Speakers’ Corner in the city.
