UNDP Challenge Prize Terms and Conditions

The UNDP Renewable Energy Challenge is run by the UNDP (United Nations Development Programme) with support from Nesta. Please read these terms and conditions carefully before submitting an entry. By submitting an entry, you accept these terms and conditions and agree to comply with them.

1 Participating in the Challenge

1.1 Entries received by the relevant deadline will be assessed against the relevant entry criteria set out in the promotional materials. Employees of UNDP and Nesta, other individuals working on the project, and their immediate families are not eligible to enter.

1.2 Late entries will not be accepted. We are not responsible for entries which are lost, damaged or late due to computer, network or telecommunications failure. You may submit more than one entry per Challenge and be named as a partner in more than one entry. You must bear all your costs of entering and participating in the Challenge, including travel costs.

1.3 Eligible entries will be assessed against the relevant judging criteria. Entries may be shortlisted and asked to complete further challenges as described in the promotional materials and performance will then be assessed against the relevant judging criteria. Participation in challenges, tests, support and other activities are a condition of participation in the Challenge.

1.4 We will use the contact details provided to contact you about the Challenge. If you do not respond within 14 days, or if you subsequently withdraw or are withdrawn from the Challenge for any reason, we may select another entry in your place, but are not obliged to do so.

1.5 The judges' decision about eligibility, shortlisting and selection, including the measurement and validity of any claims and data submitted, and about the provision of support and financial support, is final and correspondence will not be entered into.

1.6 The winners of the UNDP Sustainable Development Challenge should use the prize in ways will benefit refugees communities in Bosnia and Herzegovina. UNDP reserve the right to impose additional conditions if appropriate in its reasonable opinion if the Challenge has not resulted in sufficient public benefit or to comply with other legal requirements. 

1.7 The prize will be paid by UNDP to the winner in the currency indicated. Winners are responsible for payment of taxes, bank transfer and other charges and for any currency exchange risk in relation to the award of the prize. 

1.8 UNDP shall determine at its sole discretion the form and extent of any pilot of the winning entry as it deems appropriate in the circumstances. You will cooperate with and provide any information requested by UNDP to facilitate any such pilot or development of the winning entry.

1.9 We reserve the right at our sole discretion to refuse to accept any entry; to suspend or withdraw the Challenge at any time; to vary the form and substance of the Challenge including dates for deadlines, challenges and activities; to reduce or increase the number of entries selected for any phase, including the final prize; not to award the prize; and/or to reject any entry or withdraw a place on either of the Challenge if you are in breach of these terms and conditions, fail to participate fully, or do anything to damage the reputation of UNDP, Nesta or our partners.

1.10 We reserve the right to vary these terms and conditions at any time. Variations will take effect from the date they are posted on our website so please check regularly to see the current version.

2 Your promises to us

2.1 By participating in the Challenge, you confirm that:

  • you satisfy the relevant entry criteria and all information submitted by you is true, accurate and complete. We reserve the right to ask for additional evidence of claims made by you, to validate claims by any means we see fit and/or to reject claims at our sole discretion
  • your proposal is your own original idea and is not copied from anyone else
  • you have, or will obtain, all authorisations, consents and permissions necessary to submit your entry, carry out your proposal and comply with these terms and conditions and, to the best of your knowledge, your entry will not infringe any intellectual property or other third party rights or breach any contractual obligation
  • you will act lawfully, ethically and in good faith and comply with the rules of the Challenge and any relevant laws, regulations, guidelines and codes of practice. You will comply with the reasonable instructions of Nesta and UNDP while participating in the Challenge, including in relation to health & safety and security. We reserve the right to remove you from the Challenge if you do not comply with these rules, if you cheat or behave in a way which is disruptive, inappropriate or potentially dangerous

2.2 If you are entering as part of a group or team, the person completing the entry form is responsible for compliance with these terms & conditions by other team members.

3 Information and Publicity

3.1 UNDP and Nesta will use information which you provide, including your personal details, to administer the Challenge and may share it with our partners and anyone helping us to run the Challenge, subject to appropriate obligations of confidentiality and data protection. 

3.2 We may carry out publicity and promotion for the Challenge and publish our research and evaluation in relation to the Challenge. You agree to participate in publicity and research relating to the Challenge and consent to the use of your name, a summary of your proposal, and photographs/recordings of your participation in the Challenge in promotion and publications in any media and online. Before publication, we will take into account your concerns about confidentiality and intellectual property rights in your entry. Any public statements which you make in relation to the Challenge must acknowledge UNDP and Nesta and be approved by us in advance.

4 Limitation of Liability

4.1 To the extent permitted by applicable law, neither UNDP nor Nesta shall be liable for any direct or indirect loss or liability, costs, claims, taxes, charges or expenses resulting from your participation in the Challenge or your reliance on statements made or advice given by us, our partners or contractors. You acknowledge that UNDP is responsible for the Challenge and that Nesta is not liable for any failure by UNDP to pay the prize or to pilot or develop the winning entry. Any claim in relation to payment of the prize should be made to UNDP.

4.2 Without prejudice to Clause 4.1, the maximum liability of UNDP or Nesta to you in connection with the Challenge (if any) is limited to USD500. Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by negligence or fraudulent misrepresentation made by us.

5 Amicable Settlement: We shall both use our best efforts to settle amicably any dispute, controversy or claim arising out of the Challenge or breach of these terms or invalidity thereof.  Where either of us wishes to seek such an amicable settlement through conciliation, the conciliation shall take place in accordance with the UNCITRAL Conciliation Rules then obtaining, or according to such other procedure as may be agreed between us.

6 Arbitration: Any dispute, controversy, or claim between us arising out of the Challenge or breach of these terms, or invalidity thereof, unless settled amicably under clause 5 above, within sixty (60) days after receipt by one party of the other party's written request for such amicable settlement, shall be referred by either party to arbitration in accordance with the UNCITRAL Arbitration Rules then obtaining.  The decisions of the arbitral tribunal shall be based on general principles of international commercial law.  For all evidentiary questions, the arbitral tribunal shall be guided by the Supplementary Rules Governing the Presentation and Reception of Evidence in International Commercial Arbitration of the International Bar Association, 28 May 1983 edition.  The arbitral tribunal shall be empowered to order the return or destruction of goods or any property, whether tangible or intangible, or of any confidential information provided under the Challenge or these terms or order that any other protective measures be taken with respect to the goods, services or any other property, whether tangible or intangible, or of any confidential information provided under the Challenge or these terms, as appropriate, all in accordance with the authority of the arbitral tribunal pursuant to Article 26 ("Interim Measures of Protection") and Article 32 ("Form and Effect of the Award") of the UNCITRAL Arbitration Rules.  The arbitral tribunal shall have no authority to award punitive damages.  In addition, unless otherwise expressly provided in these terms, the arbitral tribunal shall have no authority to award interest in excess of the London Inter-Bank Offered Rate ("LIBOR") then prevailing, and any such interest shall be simple interest only.  The parties shall be bound by any arbitration award rendered as a result of such arbitration as the final adjudication of any such dispute, controversy, or claim.
